"How 'bout them Apples"
I think this might be old news but I recently came across the ITC decision from early December ruling in favor of Apple's patent gripes against HTC. Essentially the ITC agreed with Apple's contention that HTC violated essential patents relating to data arrangement and storage. With HTC commanding an estimated 24% U.S market share in 3Q11, this possible import ban could play havoc on the U.S smartphone market. I'm hoping to start a discussion about the following.
1. This seems to add some serious ammunition for Apple's current and future patent disputes, which will culminate in an all out brawl (thats already started) with Android. Should the ITC have given Apple such precedent?
2. Obviously the ITC should balance the economic pros and cons with respect to patent validity and economic damage due to trade bans but do you think they picked the best long term welfare decision for the U.S populace?
3. Perhaps the ITC has too much power?
